The police investigation
Following an investigation conducted by the journalist Hadas Steif , Naveh's ex-wife gave her his cell phone that was left in the safe at her home. After the phone was hacked, alleged evidence of accepting sexual bribes in exchange for promoting judges was found in it. [2] The phone was handed over to the Israel Police in exchange for immunity from Steif's prosecution. The police opened an undercover investigation [3] and on January 5, 2019, the head of the national unit for fraud investigations , Deputy Superintendent Yoav Talem , requested a gag order ( a judge's order that a case may not be discussed in public.) from the Magistrate's Court in Netanya regarding the affair. [4] On January 16, 2019, the police investigation became public. The police detained the lawyer Efi Naveh for questioning , the head of the Bar Association, on suspicion of bribery offenses. That evening, the gag order was partially lifted and Naveh's name was revealed as the main suspect in the case. During her investigation, Kreif deleted text messages from her cell phone. These messages were recovered by the police and revealed that the Minister of Finance and a member of the Committee for the Selection of Judges, Moshe Kahlon, was in close personal contact with Kreif, even during the period when her candidacy for appointment to the position of judge was being discussed. [12] The State Attorney's Office responded that there is no justification to investigate Kahlon with a warning , "in light of the fact that the exchange of text messages that was intercepted took place about six months after Kreif's election to judgeship." [13] But according to Aviad Glickman , the police have evidence of a connection between Kahlon and Kreif even before her appointment. [14]
At the end of the investigation, the police announced that, in their opinion, an evidentiary foundation had been formed against Efi Naveh and against Judge Esther (Eti) Kreif for committing crimes in the field of moral purity . [15] In December 2019, the prosecutor's office announced its decision to file an indictment against Naveh on charges of bribery, fraud and breach of trust , and against Kreif on charges of bribery and destruction of evidence, subject to a hearing.
